To list the propety for sale:

  • Title deed
  • Latest rates receipt (IBI)
  • Energy Performance Certificate (we can help with this)
  • Certificate of occupancy or first occupancy licence, if the property is a new build

To finalise the sale:

  • National Identity Document (DNI) or Foreigner's Identity Number (NIE)
  • Updated property registry certificate (we apply for this)
  • Latest 4 propety tax (IBI) receipts or a certificate from the Town Hall confirming that you are up to date with payments.
  • Latest utility bills (water, electricity, etc.)
  • Certificate of being up to date with community fees (if applicable)
  • If there is a mortgage, a certificate of zero balance or outstanding debt

What is the Energy Efficiency Certificate "CEE"?

This document is mandatory for selling or renting a property. It indicates how much energy your home consumes and its energy efficiency rating, similar to the energy laber on appliances. This certificate is issued by an authorised technician after visiting the property and is valid for 5 or 10 years, depending on the rating.

Without this certificate, the sale cannot be finalised, nor can the property be legally advertised. If you don't have one, don't worry, we can help you obtain it.

  • Notary and registration fees: If you have an outstanding mortgage and it is paid off at the time of the sale, the notary and registration fees associated with the mortgage cancellation will be your responsability.
  • Estate agency fees: These fees are usually a percentage of the property's sale price.
  • Personal Income Tax (IRPF): If you make a profit from the sale of the property, you will have to pay tax on that profit when you present your next tax return, calculated on the increase in the property's value.

In addition to the expenses mentioned in the previous section, if you are a non-resident seller in Spain, you have other tax and legal obligations to fulfill when selling a property in the country:

  • Retention tax: As a non-resident seller, you will be subjected to a 3% retention tax on the sale price. This amount will be deducted on the day of the transaction and paid to the Spanish Tax Agency (AEAT). The buyer must retain this amount and pay it to the tax officer (AEAT), although the ultimate responsability for payment rests with you as the seller.
  • Capital Gains Tax: The capital gain generated from the sale of the property is taxed at a rate that varies depending on the amount of the gain. It is declared using form 210.

Do I need an occupancy certificate to sell my home?

According  to the Balearic Islands Housing Law, a certificate of occupancy is not a legal requirement for selling your property unless it is a new build. However, if you do not have this document, it is essential that this be explicity stated in the contract or deed of sale. In other autonomous communities, however, presenting a certificate of occupancy is mandatory to complete the sale of the property.
