Expenses when buying a property

  • Property Transfer Tax (ITP) of buying a resale property, or Value Added Tax (VAT) and Stamp Duty (IAJD) if buying a new build: These taxes are calculated on the purchase price of the property.
  • Notary and Land Registry fees: you must pay the notary fees for drawing up the deed of sale and the property registration fees.
  • Bank Valuation: If you finance the purchase with a mortgage, the bank will require a valuation of the property, the cost of which you will be responsible for.

What do I need to buy a property as a non resident in Spain?

  • Foreigner Identification Number (NIE): Obtaining a NIE is mandatory and necessary for all legal and tax procedures in Spain.
  • Spanish Bank account: While not mandatory, having a bank account in Spain simplifies both the buying and selling process and subsequent payments related to the property.
  • Financing: You can obtain a mortgage in Spain. Banks generally offer up to 60-70% of the popery value to foreign buyers.
  • Taxes: Notary and registration fees. As a non resident buyer, you will be subject to the same purchase taxes as a resident, these being Property Transfer Tax (ITP) for resale properties, or VAT for new build properties.
  • Additional expenses: It is recommended to contact a local lawyer to assist with tax and legal matters.

However, if you do not have this document, it is essential that this be explicity stated in the contract or deed of sale. In other autonomus communities, however, presenting a certificate of occupancy is mandatory to complete the sale of the property.

This certificate is issued by a qualified technician and is valid for 5 or 10 years depending on the rating.
